Refund policy

 

Equally, it's rather horrible to discover that something is missing, damaged or incorrect and have all the hassle of demanding a refund or getting the items replaced. So we do our best to ensure that you receive what you order as quickly as possible and without problems.

We don't want to spoil your enjoyment.

But sometimes things do go wrong, despite our best intentions. We have to rely on people who are not employed by us (e.g. warehouse workers and delivery drivers).

However, if the worst happens, we want to put things right as quickly as possible. We need YOUR help to achieve this. Don't delay in telling us if something is wrong - even if you think you can put it right without bothering us. We WANT to be bothered; that's what you are paying for.

We want your whole buying experience to be FUN.

Right to cancel

You have the right to cancel the contract within 14 days without giving any reason.
The cancellation period will expire after 14 days from the day on which you acquire or a third party other than the carrier and indicated by you acquires:
physical possession of the products, or
in the case of a contract relating to multiple products ordered by you in one order and delivered separately, physical possession of the last product, or
in the case of a contract relating to delivery of a product consisting of multiple lots or pieces, physical possession of the last lot or piece.
To exercise the right to cancel, you must inform us  New mill Fishing ltd, Cleghorn Lanark ML11 7SL, telephone 01555870730 or by email at mail@fishingmad.co.uk of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the model cancellation form at section 4 below, but it is not obligatory.
The law says that you are responsible for proving that you cancelled the contract, so to avoid disputes, it is a good idea to use a traceable method of posting or set a read receipt on your email.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation

If you cancel the contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
We may make a deduction from the reimbursement for loss in value of any products supplied, if the loss is the result of unnecessary handling by you. Please be aware in particular that an RIB or similar high value item will probably lose 40-50% of its value when used, but we usually limit the deduction to 35% of the purchase price for a product returned to us in a used condition.

We will make the reimbursement without undue delay, and not later than (a) 14 days after the day we receive back from you any products supplied, or (b) (if earlier) 14 days after the day you provide evidence that you have returned the products, or (c) if there were no products supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. Where you are returning the products, we may withhold reimbursement until we have received the products back or you have supplied evidence of having sent back the products, whichever is the earliest.

You will have to bear the direct cost of returning the products.

You shall send back the products or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the products before the period of 14 days has expired.

You are only liable for any diminished value of the products resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the products.

Customers can return a product themselves but must exercise reasonable care in doing so.
Please use a traceable method of posting as we cannot be responsible for any items lost in transit.

b. Taking care of the product before it is returned

If you want to handle or otherwise try out the product at home, you must do that in the way you would in our store. You can do what you need to in order to establish the product's nature, characteristics and functioning. In other words you can do what would reasonably be allowed in a store.
If your use of the product extends beyond that, and you then cancel the contract, you will have to pay us for the reduction in value of the product. For any product, the sum we will recover will never be more than the contract price. We will deduct this sum from your refund, or if we have already paid you the refund, you must pay the sum to us separately.

c. Collection charges (cost of return)
You will have to bear the direct cost of returning the products.
Collection charges are applied on a case-by-case basis depending on the nature of the product and where it is collected from. All collection charges will reflect our direct costs of collection and will be agreed with customers in advance. Alternatively customers can return a product themselves but must exercise reasonable care in doing so.
